Terms of Service

1. Acceptance of Terms

By accessing or using Awesome ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Awesome is an Agentic Work Environment — a desktop application that enables collaboration between humans and AI agents within a shared workspace. The Service includes the desktop application, optional cloud sync, and hosted AI inference capabilities.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Use the Service in any manner that could damage, disable, or impair the Service

5. Your Content

You retain ownership of all content you create, upload, or process through the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely to provide and improve the Service.

You are responsible for ensuring you have the necessary rights to use any content you process through the Service.

6. API Keys and Third-Party Services

You may connect third-party AI providers using your own API keys. Your use of third-party services is subject to those providers' terms of service. We are not responsible for the actions, content, or policies of third-party providers.

7. Subscription and Payments

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.

We reserve the right to modify pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

8. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by AtomicoLabs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that AI-generated content will be accurate, complete, or suitable for any purpose. You are responsible for reviewing and validating all AI-generated outputs.

10. Limitation of Liability

To the maximum extent permitted by law, AtomicoLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless AtomicoLabs and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or through the application. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
